Terms of service

These terms govern your use of this store. By browsing it or buying from it, you agree to them. Please read section 11 in particular — it explains what this store is and is not.

In these terms, "we" and "us" mean Human Medical, which operates this store.

1. Who can buy

You must be at least 18 and able to enter into a contract. By placing an order you confirm that you are.

2. Products

Everything sold here is a cosmetic product for external use on the skin. We have tried to describe each product accurately, including what its manufacturer publishes about the formula. Colours and finishes can look different on different screens, and packaging occasionally changes without notice from the manufacturer.

We may limit quantities, restrict sales, or discontinue a product at any time.

3. Prices

Prices are in US dollars and can change without notice. The price you pay is the price shown at the moment you check out.

4. Orders

Your order is an offer to buy. We accept it when we send the confirmation email.

We may refuse or cancel an order — for example where a product is out of stock, where a price or description was wrong, or where an order looks fraudulent. If we cancel an order you have already paid for, we refund it in full.

5. Errors

Occasionally something on this store will be wrong: a price, a description, a stock figure. We reserve the right to correct any error and to cancel an order placed on the strength of one, even after the order is confirmed. We are not obliged to update this store's information except where the law requires it.

6. Payment

You confirm that the payment method you use is yours and that the details you give are true and complete. Card details are handled by our payment processor. See our privacy policy.

7. Shipping and returns

Set out in full in our shipping policy and refund policy. Both form part of these terms.

8. Your account

If you create an account, you are responsible for keeping the password to yourself and for what happens under the account. Tell us if you think it has been used without your permission.

9. Acceptable use

Do not use this store for an unlawful purpose, to upload anything malicious, to scrape it, to interfere with its security, or to harass anyone. We may end your access if you do.

10. Third-party links

This store links to other sites we do not control. We are not responsible for their content or their practices, and a link is not an endorsement.

11. This is a store, not medical advice

This is important, so it is set out plainly.

Everything sold here is a cosmetic product. It is intended to cleanse, moisturise and improve the appearance of skin. It is not a drug.
Nothing on this store is intended to diagnose, treat, cure or prevent any disease or condition, and nothing here has been evaluated by the Food and Drug Administration.
The information on this store, including anything written by or attributed to a physician, is general information and not medical advice. It is not a diagnosis, it is not a treatment plan, and it is not written for you specifically.
Buying from this store, or reading it, does not create a physician-patient relationship with Adam Mauer, M.D., with Human Medical Aesthetics, or with anyone else.
Consult your own physician before you start any new product, particularly if you are pregnant, breastfeeding, have a skin condition, or are undergoing a cosmetic procedure. Never delay seeking medical advice because of something you read here.
These products are for external use only. Patch test before first use and stop using a product if irritation occurs.

12. No warranty

This store and everything on it are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the store will be uninterrupted or error-free.

Nothing in these terms excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this store or from any product bought here. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned.

14. Indemnity

You agree to indemnify us against any claim arising from your breach of these terms or your violation of any law or the rights of a third party.

15. Governing law

These terms are governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction over any dispute.

16. Severability and entire agreement

If any part of these terms is found unenforceable, the rest continues to apply. These terms, together with the policies linked from them, are the whole agreement between us about this store.
